Terms and Conditions
These Terms and Conditions apply to purchases made directly through the Upper East Fine Arts website. By placing an order, you agree to the terms below.
About Upper East Fine Arts
Upper East Fine Arts is an independent art dealer specializing in original and collectible works of art, including Old Master prints, drawings, antique and vintage works on paper, and selected modern works.
Artwork Descriptions
We make every reasonable effort to describe each artwork accurately and in good faith based on our examination of the work, available scholarship, catalogue raisonné information, provenance, inscriptions, and other relevant sources.
Attributions, dates, states, editions, catalogue references, and other scholarly information may reflect the current state of research and may be subject to revision as new information becomes available.
Photographs form part of the description of each artwork. Buyers are encouraged to review all images, dimensions, condition information, inscriptions, catalogue references, and other listing details before purchasing.
Additional photographs or condition information are available upon request.
Condition
Many artworks offered by Upper East Fine Arts are antique or vintage and may show characteristics consistent with age and prior handling. These may include toning, foxing, staining, creases, small tears, trimming, mounting, restoration, previous framing, or other signs of age where disclosed or visible in the listing.
Condition descriptions are provided in good faith and are intended as a practical guide rather than a professional conservation report unless specifically stated otherwise.
Availability
Most artworks offered by Upper East Fine Arts are unique or available in a single example. Works may also be offered through other sales channels.
In the unlikely event that an artwork becomes unavailable after an order is placed, the order will be cancelled and any payment received will be refunded in full.
Prices and Payment
All prices are listed in U.S. dollars unless otherwise stated.
Payment must be successfully completed before an artwork is shipped. We accept the payment methods displayed at checkout.
Prices may be changed at any time before a purchase is completed. Once an order has been accepted and paid, the agreed purchase price will not change.
Sales Tax
Applicable sales tax will be calculated and collected where required by law.
Shipping Within the Contiguous United States
Standard shipping within the contiguous United States is complimentary unless a different shipping charge is clearly shown for a particular artwork.
Large, heavy, framed, or oversized artworks may carry an additional shipping charge, which will be shown at checkout where applicable.
We reserve the right to select an appropriate carrier and shipping service based on the artwork’s size, value, destination, and packaging requirements.
Signature confirmation may be required for higher-value shipments.
Alaska, Hawaii, and International Shipping
Automatic website checkout is not currently available for Alaska, Hawaii, or international destinations.
Buyers in these locations are welcome to contact Upper East Fine Arts for a shipping quote before purchase. Eligible artworks may also be purchased through our eBay store where applicable shipping services, including eBay International Shipping, may be available.
For international shipments arranged directly with Upper East Fine Arts, the buyer is responsible for any customs duties, import taxes, brokerage charges, or other destination-country fees unless otherwise agreed in writing.
Shipping Damage
If an artwork arrives damaged, please request a return within 7 calendar days of receiving the package and retain the artwork, shipping box, and all packing materials. Photographs of the artwork and packaging may be required so that we can evaluate the damage and file a carrier claim where appropriate.
Please do not discard packaging or return an artwork before receiving instructions from us.
Returns and Refunds
Because the artworks we sell are individually described and photographed, returns are accepted only for damaged or misdescribed items. You must request a return within 7 calendar days of receiving the package. This is the deadline to request a return; the returned artwork does not need to arrive back within those 7 days.
Any return must be authorized by Upper East Fine Arts before the artwork is sent back.
For complete information, please see our Refund and Returns Policy.
Order Cancellation
If you need to request cancellation of an order, please contact us as soon as possible. We will make reasonable efforts to accommodate cancellation requests that are received before an artwork has been shipped.
Once an artwork has been shipped, the order is subject to our Refund and Returns Policy.
Images and Website Content
Photographs, written descriptions, research, catalogue notes, website design, and other original content created by Upper East Fine Arts may not be reproduced for commercial purposes without permission, except as otherwise permitted by law.
Copyright in an artwork itself may belong to the artist, artist’s estate, or another rights holder and is not transferred merely by the sale of the physical artwork.
External Platforms
Purchases made through third-party platforms such as eBay are also subject to the applicable terms, policies, payment procedures, and buyer protections of those platforms.
Limitation
Upper East Fine Arts is not responsible for delays or disruptions caused by carriers, customs authorities, severe weather, or other circumstances outside our reasonable control.
Nothing in these Terms and Conditions excludes or limits rights or remedies that cannot legally be excluded or limited.
Changes to These Terms
We may update these Terms and Conditions from time to time. The version in effect at the time an order is placed will apply to that purchase.
